Ms. Dennison:

This is in response to Mr. O'Malley's recent correspondence following our phone conversation. By way of introduction, I am Ms. Denin's supervisor -and am the lead attorney. As was requested in that phone conversation, I provided my name, and my address and phone number appears below. For reasons that remain unclear, Mr. O'Malley, who has not identified himself as an attorney, continues to correspond on your behalf.

 

Because his recent correspondence continues to focus on the certification of our technicians (an issue we have already responded to) and now seeks information about my supervisor, I will repeat, I am the senior attorney who oversees all matters in this department as needed. If you would like to know our chief executive officer's name, even though any phone calls or correspondence will be forwarded directly back to myself, his name is Richard Schulze.

 

Ms. Dennison and Mr. O'Malley, we have provided repeated recommendations for attempting to resolve the apparent problems with your computer. Although Ms. Dennison's intentions are unclear, it seems clear that Mr. O'Malley insists on ignoring our recommendations and instead chooses to focus on the background of our computer technicians and learning the corporate hierarchy of Best Buy Stores, L.P. Perhaps that energy would be better expended on focusing on resolving the problem. Therefore, I will once again repeat our recommendation: have your

computer diagnosed by another factory authorized servicer and we will pay the diagnostic fee

only. If they agree with our analysis and you choose to have them remedy the software problems, that will be at your expense. If they determine there are hardware problems, we reserve the right to have the opportunity to remedy the problems. (For your information, I refer you once again to Ms. Denin's letter dated March 1 1, 199 8).

 

1 sincerely hope the efforts Mr. O'Malley continues to put forth in communicating on your behalf in this matter be focused on solutions along the lines that have been suggested. Having said that, we will no longer correspond with either of you if you are unwilling to consider the solution that has been offered. I will restate that: in other -words, -any additional correspondence received will not be responded to. As discussed, we will :await receipt from you of invoice of another factory authorized service provider, should you choose to proceed as requested. Otherwise, and although I discussed with Mr. O'Malley my belief that if litigation was commenced that it would be unfortunate, giving our willingness to attempt a resolution, if you choose not to explore all possible means of resolving this matter, then regrettably, litigation would be the logical next step.
